Terms of service
The General Terms and Conditions (GTC) govern the relationship between Coffee Architects AG (Seller) and its customers (Buyer) regarding all orders placed in writing, via telephone, the online shop (coffee-architects.com), and emails. Provisions of the Buyer that conflict with these GTC are hereby expressly objected to.
General
The General Terms and Conditions are the basis for a fair customer relationship. By submitting an order, the customer agrees to the General Terms and Conditions. We make every effort to serve our customers according to their needs and to their full satisfaction.Scope of Offers
The offers in our online shop are non-binding, can be changed at any time and are aimed exclusively at buyers based in Switzerland.The deliveries, services and offers of the Seller are made exclusively on the basis of these General Terms and Conditions in the version valid at the time of the conclusion of the contract, even if the offer is accessed from outside Switzerland.The Seller does not recognize conflicting or deviating GTC and hereby expressly objects to them. Conflicting GTC of the customer shall only form the basis of the contract if the Seller expressly agrees to them in writing.
Conclusion of Contract
By ordering goods via the online shop (coffee-architects.com), by telephone or e-mail, the Buyer bindingly declares that they wish to purchase the ordered goods. By submitting their order, a legally binding offer to conclude a contract is created.
Prices
All prices stated are in Swiss Francs and include the statutory value-added tax and other price components plus postage and packaging costs. All offers of goods presented by the Seller are – also regarding the price information – subject to change and non-binding.
Price changes and time-limited promotions are possible at any time and do not require notice. However, those prices that were published on the internet/online shop at the moment of the order and at the time of receipt of the order shall always apply.
Payment
Individual invoices are payable net within 10 days of the invoice date.
In the event of non-compliance with this payment period, the Buyer shall be in default upon the first reminder. The first reminder is free of charge; for the second reminder, reminder fees of CHF 20.- follow, and for the third reminder, reminder fees of CHF 30.- follow. If no payment has been made after the third reminder, we reserve the right to engage a collection agency to assert the claim. Any further costs for the collection of the claim will be charged in full to the Buyer.
The prices indicated on the internet pages at the time of receipt of the order shall apply. In particular, price changes result from changed supplier and/or manufacturer prices. Price increases will be communicated to the Buyer before delivery and their consent obtained. Price reductions will be passed on without notification.
The Seller reserves the right to execute orders from new customers and from existing customers for larger orders only against advance payment. However, the Seller reserves the right to reject such requests without giving reasons. The delivered goods remain the property of Coffee Architects AG until the invoices have been paid in full. Coffee Architects AG is entitled to make a corresponding entry in the retention of title register responsible for the Buyer.
No Guarantee for Product Information and Availability and Warranty Information
The Seller reserves the right to possible errors, printing mistakes, technical or color changes despite the greatest possible care. Likewise, the Seller assumes no liability for the accuracy of the manufacturer's information.
Retention of Title
The goods remain the property of the Seller until full payment has been made. Prior to the transfer of ownership, resale, rental, pledging, assignment as security, processing, other disposal or transformation is not permitted without the express consent of the Seller.

Order Processing
The order will be checked after electronic receipt. Any changes will be communicated by telephone or electronically within three working days.Delivery
The risk shall pass to the Buyer upon dispatch of the goods. Information on availability and any delivery periods are not binding. Delivery is made either by post or by courier only within Switzerland. Deliveries will be delivered to the post office or the transport company no later than 5 working days after receipt of the order. If the customer expressly requests it, orders will be sent by express or courier service. For such shipping methods, however, the postage will always be charged.
The Seller is entitled to withdraw from the contract and demand the return of the goods in the event of behavior by the customer in breach of contract, in particular in the event of default in payment or breach of a duty.From a goods value of 60 francs, we deliver free of charge within 2 to 3 days throughout Switzerland. Shipping is via PostPac Economy (B-Post). All products that we have in stock are shipped with Swiss Post.

For wholesalers and distributors, we charge the actual shipping costs.P.O. box addresses will not be delivered to. Coffee Architects AG is not liable for delivery delays caused by transport companies or other third parties.In the event of force majeure, traffic or operational disruptions, strikes, shortages of raw materials and the like, the delivery time shall be reasonably extended. If the causes of the delay persist for more than four weeks after the conclusion of the contract, each party is entitled to withdraw from the contract.
Should not all ordered items be in stock, the Seller is entitled to make partial deliveries at its own expense, provided this is reasonable for the Buyer.
Since the goods are partly natural, exclusive and limited in availability, the Seller reserves the right to restrict delivery quantities for large orders if necessary, or to deliver in several tranches, or to make a distribution in the event of excess demand for a good, or to withdraw from the contract entirely.
Upon handover of the goods for dispatch to Swiss Post or another carrier, all risks associated with the goods shall pass to the Buyer.
Customs Duties
Customs duties for international orders: No customs duties apply to deliveries to other European countries. Except for Germany, which charges 2.30 Euro coffee tax per kilo of coffee.
Notice of Defects & Right of Return
The condition of the received goods must be checked immediately upon receipt; after 2 working days, the delivery is deemed approved. No replacement will be provided for damage resulting from improper storage by the recipient.
The costs for the return shipment are borne by the Buyer. If the goods are damaged or lost during return shipment, the Seller is entitled to demand compensation from the Buyer for the reduction in value. Ground coffee is excluded from return.
Guarantee / Warranty
The Buyer shall report obvious defects no later than 2 days after receipt of the delivery, and defects discovered later at the time of knowledge. Otherwise, the goods are deemed accepted. Damage for which the Buyer is solely responsible, e.g., due to improper handling, natural wear and tear or external influences for which the Seller is not responsible, is excluded from warranty.
The warranty period for coffee machines, coffee grinders or accessories is 2 years (proof of purchase required) from delivery. For household appliances used in gastronomy or in the office, a warranty period of 1 year applies.
The warranty covers material and labor at Coffee Architects AG (bring-in). Any claims of the Buyer against the Seller that are not related to the ordered goods are excluded, regardless of the legal basis. This also applies to auxiliary persons or vicarious agents of the Seller.
Excluded from the warranty and liability of Coffee Architects AG are damages caused by improper handling or as a result of faulty construction, poor execution or other reasons for which Coffee Architects AG is not responsible. All cases of breach of contract and their legal consequences, as well as all claims of the purchaser, regardless of the legal basis on which they are made, are conclusively regulated in these conditions. In particular, all claims not expressly mentioned for damages, reduction, rescission, cancellation of the contract or withdrawal from the contract are excluded. Liability for consequential damages is excluded, unless mandatory product liability legal provisions or other applicable law prevent this.
Data Protection
When collecting, processing and using data relating to persons or companies, the Seller complies with the provisions of Swiss data protection legislation. Data necessary for business processing will be stored and, if necessary, forwarded to affiliated companies as part of order processing. Address data may also be used for advertising purposes, whereby you can object to this use of data at any time.Furthermore, for the purpose of credit checks, we maintain a data exchange for credit information.(siehe: coffee-architects.com/policies/privacy-policy)
Place of Jurisdiction
All obligations arising from these order contract relationships are subject exclusively to Swiss law. The place of performance and sole place of jurisdiction is Zurich (Switzerland).
In any case, the relationship between Coffee Architects AG and the customer is subject to Swiss law in accordance with the provisions of the Swiss Code of Obligations (CO) and the Swiss Civil Code (CC).
Liability
Coffee Architects AG assumes no liability in the event of non-deliverability or delayed delivery of products due to incorrectly declared delivery addresses, absence of the recipient, customs problems (export) or events attributable to force majeure.
DisclaimerThe author assumes no liability regarding the correctness, accuracy, timeliness, reliability and completeness of the information.
Liability claims against the author for damage of a material or immaterial nature arising from access to or use or non-use of the published information, through misuse of the connection or through technical faults are excluded.

Changes to the GTC of Coffee Architects AG are reserved at any time. The respective legally valid version is published on the website.
